Rokoduguni unfair dismissal

2016-11-24 Jennifer Renney posted:

All you rugby fans out there will know that winger Semesa Rokoduguni performed brilliantly for the England team in the match against Fiji last Saturday when he scored two tries, made 139m and six clean breaks.

Rokoduguni was Man of the Match one minute, but then cut from the England squad by the boss the next.

Was this fair? Probably not when you consider past and current performance. Are the rest of the team demotivated by this? Probably yes.

The parallels with the workplace might be a bit strained, but it is true to say that many workers suffer similar treatment, which can often be unfair or discriminatory. However the law does offer protection against loss of livelihood through unfair treatment or discrimination, and if you’re the boss you need to know what the law will allow you to do. It isn’t just a case of avoiding an employment tribunal claim for unfair dismissal, it’s also about treating staff fairly and keeping your team motivated.

That’s where Renney and Co can help, as specialists in our field.
